Appraisal Not Waived After Two Years of Litigation

In Fla. Ins. Guar. Assoc. v. Hillard (1D09-0286), the First District affirmed the trial court's conclusion that appraisal was not waived. The decision was a PCA decision. After being in contested litigation for over two years, the trial court ordered an appraisal. The decision was affirmed.
