Second District Reverses Because Payments Improperly Circumvented Priority of Payments in Florida Probate Code

In Copeland v. Buswell (2D08-3238), the Second District reversed:

Because Mr. Buswell and Patco Transport's payment improperly circumvented the priority of payments set forth in Florida's probate code and because the payment was made without the knowledge and consent of the personal representative, we reverse the portion of the final judgment denying the claim for medical expenses. We affirm the remainder of the final judgment.
